Ma oggi c’è una proposta nuova, che spaventa: il Sottosegretario al Welfare e alla Sanità, Fazio, qualche giorno fa all’Assobiomedica di Milano ha annunciato di voler depenalizzare gli errori medici, non definendo ancora se con decreto o con disegno di legge. Motivazioni? Beh….troppi processi, troppo lunghi, costi elevati per assicurare strutture pubbliche (oltre 500 milioni di Euro). E allora, quando i processi sono troppi e la macchina giudiziaria comincia a pesare….anche sulle tasche dello Stato…allora depenalizziamo. Che dire? Questo è lo stato di diritto!! Sarebbero molti gli interventi normativi da attuare, per depenalizzare e al tempo stesso indagare e pagare in fretta i danneggiamenti. E le intercettazioni, se il reato è amministrativo, si possono fare? Con la depenalizzazione il caso Santa Rita non sarebbe mai finito in Tribunale. Ma il governo Berlusconi, con il tempismo che lo contraddistingue, subito dopo il caso Santa Rita fa la proposta, che poi Fazio, viste le reazioni, cerca un po’ di stemperare, ma questa è la volontà.
La cosa che mi ha atterrita ancora di più, è che questo progetto, poi mai presentato alle Camere, era già stato preso in esame dal precedente ministro Turco…insomma questa responsabilità penale non piace ai Ministri della Sanità! Che succede? Diventano ministri e si ergono a protettori della casta di quelle figure sacre dal camice bianco; non ce l’ho con i medici, sia chiaro, ma il medico deve rispondere penalmente della sua attività, così come ogni altra persona, che vi sia dolo o colpa, dunque imperizia, o che vi sia stata omissione. Nel proporci questa depenalizzazione ci continuano a dire che bisogna escludere che il medico paghi per cause o fatti imprevedibili, che sicuramente, nel campo medico diagnostico si possono verificare. Ma questa non è cosa nuova, ce lo dice il nostro codice penale e la nostra giurisprudenza e dottrina, che si occupano del nesso di causalità dal 1930, anno in cui risale il nostro codice.
Inoltre in molti casi il reato penale è per il paziente/cittadino l’unica forma di difesa, anche perché il semplice procedimento civile rischia di essere inefficace: oltre 10.000 euro e oltre 10 anni solo per il primo grado.
Allora sig. Fazio, vuole che si ricorra meno allo strumento penale? Cominciamo a far funzionare anche in Italia, come in altre nazioni, forme di tutela extragiudiziale, come la conciliazione pressoché sconosciuta in ambito sanitario italiano o associazioni professionali che, a differenza degli ordini dei medici, agiscono prontamente e duramente contro i professionisti che abbiano agito con negligenza e imperizia.
Ma lo strumento penale non si tocca, ricordiamo al sig. Fazio e a tutti coloro i quali lo avessero dimenticato, che il bene vita e il bene salute sono due beni di rango costituzionale e come tali non possono che meritare la massima protezione. Vanno rispettati i limiti della reale responsabilità ma per questo l’apparato penale ha i suoi strumenti e non occorre depenalizzare.
Dunque ancora una volta il sistema rischia di essere più malato di noi che entriamo negli ospedali per chiedere aiuto...........E’ questo il collasso???
